The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to scale up the pay of the petitioner at par with her junior i.e. respondent No.6.

Learned counsel is praying for stepping up the pay of the petitioner, for it to be at par with the junior-respondent No.6, in view of the instructions dated 14.03.2017, vide which, it was decided to step up the pay of General category employees from the date when the junior, belonging to the reserved category, was promoted. In this regard, a legal notice dated 28.11.2023, Annexure P-4, has been served upon respondents, which has not yet evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner and in case a direction is given to the respondents to decide the same in a time bound manner.

At the asking of the Court, Mr. A.S. Bains, AAG Punjab accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondents to decide the legal notice dated 28.11.2023, Annexure P-4, taking note of the pleas raised, within a period of 6 months and if found entitled, necessary benefits be granted to the petitioner forthwith.
