#$ !% Present petition has been filed under Section 438 Cr.P.C. seeking grant of anticipatory bail to the petitioner Sukhdev Singh @ Sonu in the case by way of appeal pending in the Court of learned Sessions Judge, Amritsar against the judgment of conviction dated 19.09.2013 passed by learned Judicial Magistrate 1st Class, Amritsar in Complaint No167 dated 18.07.2008.

   Learned counsel for the petitioner submits that in consequence of the orders of interim bail dated 28.05.2015 passed by this Court, the petitioner has appeared before the trial Court and has been released on interim bail, which fact could not be controverted by learned counsel representing the complainant/respondent No.1 as well as learned State counsel and which is also reflected from the record of the trial Court.

In the light of above and the fact that sending the petitioner into custody will not subserve any purpose, the interim bail granted to the petitioner vide order dated 28.05.2015 is made absolute subject to compliance under Section 438(2) Cr.P.C. However, the trial Court is at liberty to proceed ahead under the provisions of Section 446 Cr.P.C. The petition stands disposed off accordingly. $  "
