CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. S.K.Garg Narwana, Senior Advocate with Mr. Nitin, Advocate for the petitioner.
Mr. R.D.Sharma, DAG, Haryana.
*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing respondents No.1 and 2 for fixing seniority of the petitioner and respondent No.3 as per the Rules and the earlier decisions (Annexures P-2, P3 and P-7) of respondents No.1 and 2. 2.
Petition was filed in the year 2001 and has been lying admitted ever since.
3. On a Court query, learned counsel for the petitioner submits that he is unable to effectively ascertain whether any cause of action still survives to seek the relief owing to sheer lapse of time of more than 20 years when the petition was filed.
4.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 21 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same. MAMTA MALHOTRA 2022.07.18 14:14 I attest to the accuracy and integrity of this order/judgment Chandigarh
CWP-4689-2001 (O&M) -25.
Be that as it may, writ petition is disposed of with liberty to the petitioner to file an appropriate application in case any cause of action still survives.
