ARVIND SINGH SANGWAN J. (Oral) The petitioner alleges violation of the order dated 07.03.2018 vide which the Additional District Judge-cum-Special Commercial Court, Gurugram, has allowed the application filed under Section 9 of the Arbitration and Conciliation Act and the stay order was passed restraining the respondents from alienating/dispossessing any movable or immovable assets and the respondents were further directed to furnish the security/bank guarantee to the tune of Rs.2.93 crores till the time, the parties approach the Arbitrator. Counsel for the respondent has stated at Bar that the Arbitrator has already given an award and the application under Section 34 of the Arbitration and Conciliation Act filed by the respondent also stands dismissed.
In view of the above, the present contempt petition is disposed of.
However, liberty is granted to the petitioner to avail the alternative remedy, in accordance with law.
