The petitioner-Association through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the respondents to grant to its members pay scale of Rs.325-495 w.e.f. 01.01.1978 and Rs.810-1440 w.e.f. 01.01.1986. It is further assailing award dated 07.10.1999 (Annexure P-2) whereby Labour Court has rejected its claim.

The petitioner is an association of employees who are working in urban areas. They are claiming that they should be paid salary at par with similarly situated workers who are working in rural areas. The petitioners are employed for the purpose of Anti Larva Scheme. CWP-838-2000 (O&M) because of nature of job. The respondent is of the opinion that job in the rural area is arduous work in comparison to duties in cities. 3.

Mr. Sehgal, expressed his inability to controvert the fact that petitioners are posted in urban areas whereas they are claiming salary at par with workers who are working in rural areas and job in rural areas is arduous. The petitioners are performing the same duty but their nature of duty is little different from workers working in rural areas, thus, they cannot claim pay parity.

This Court does not find any infirmity in the impugned order.
