AT CHANDIGARH CWP-5999-2026 Date of Decision :23.04.2026 Petition herein is, inter alia, seeking a writ in the nature of certiorari for quashing the order dated 10.03.2025(Annexure P-21) passed by respondent No.1, vide which, the revision petition filed by the petitioners was dismissed.

At the outset, learned counsel for the petitioners submits that he may be permitted to withdraw the present writ petition, however, with liberty to the petitioner Nos. 4 to 7, whose area has been kept joint in the present partition proceedings and reflected in pink colour in the site plan (Annexure P-13) at page No.113 of the paper-book; to file an independent application for partition of the land by making a specific prayer for carving out their blocks (kurrahs) in a manner, so that the area to be allotted to them is contiguous to the other area of their family members. 3.

It goes without saying that, in case, any fresh application for partition in respect of the area which has been kept joint between petitioner Nos.4 to 7 herein with others in the present partition proceedings, is submitted by petitioner Nos.4 to 7, the same shall be considered by the authorities on its own merits and on the basis of the averments made in the partition application.
