HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail to the petitioner in case FIR No.119 dated 12.8.2017 under Sections 392,398,427 IPC and Section 25 of the Arms Act, 1959 registered at P.S Badagudha, District Sirsa. The petitioner is facing trial in the said case and is on bail. On account of his failure to appear before the trial Court on 06.12.2018, bail bonds and surety bonds of the petitioner were directed to be forfeited and non-bailable warrants were issued against him. Learned counsel for the petitioner states that in fact, the petitioner was present before the trial Court on 06.12.2018, however, the petitioner misunderstood that the case had been adjourned, therefore he left the court premises. His non-appearance before the Court was not intentional.

He undertakes that the petitioner shall appear before the learned trial Court on any date to be fixed by this Court. Having heard learned counsel for the petitioner and taking into account the facts of the present case, this petition is disposed of with the MANOJ KUMAR 2019.03.

On his doing so, he shall be released on interim bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the trial Court to continue appearing before it as and when required apart from following all the terms and conditions fixed in this respect.
