M.M.S. BEDI, J (ORAL) Petitioner seeks concession of pre-arrest bail in a case registered at the instance of Veena Rani alleging that the petitioner had treated her with cruelty. There are allegations of beatings and taunts in order to get more dowry. The petitioner was allegedly responsible for two abortions on account of severe beatings given by the petitioner.
Counsel for the petitioner has submitted that it was the second marriage of the petitioner as well as the complainant. The petitioner has got two children from previous marriage. The complainant had not disclosed about one child from her first marriage
CRM-M-18404-2014 (O&M) which resulted in the controversy and dispute. I have heard the learned counsel for the petitioner as well as the learned counsel for the complainant. There are serious allegations of cruelty and demand of dowry. The petitioner has even gone to the extent of filing a divorce petition and levelling allegations against the complainant. An attempt had been made to bring about reconciliation but unfortunately no final compromise could be arrived at between the parties.
In view of serious allegation of beatings and maltreatment, I do not find any extra ordinary exceptional circumstances to grant the concession of pre-arrest bail to the petitioner.
This petition is dismissed without prejudice to the rights of the petitioner to seek concession of regular bail. It will be open to the petitioner to approach this Court again in case some amicable settlement is arrived at between the parties. (M.M.S. BEDI) January 23, 2015.
