(Oral) The allegations against the petitioner are that he was having illicit relationship with Komal wife of Vijay Kumar and that on 23.7.2016 while Vijay Kumar @ Vicky was coming from village Tapa, he received threatening telephonic call from the petitioner and in the area of village Chak Fateh Singh Wala was stopped by the petitioner-accused along with other 4/5 unidentified persons and in the process kidnapped Vijay Kumar @ Vicky.

The petitioner earlier moved CRM-M-39850-2017 which was allowed vide orders dated 31.10.2017 granting him bail in case FIR No. 164 dated 25.7.2016, under sections 364,323,436,379-B,506,120-B, 148 and 149 IPC, Police Station Nathana, Bathinda.

Criminal Misc. No. M-19356 of 2018 -2In the present supplementary bail application, counsel for the petitioner submits that due to omission in the earlier petition filed by the petitioner, section 341 IPC could not be mentioned in the head note and prayer clause and prays that bail to the petitioner be also granted under section 341 IPC. The same is not opposed by the State. In view of the aforesaid, the present supplementary bail application is allowed. Petitioner is ordered to be released on regular bail in case FIR No. 164 dated 25.7.2016, under sections 341/323/364/148/149/506/ 435/395/120-B IPC, Police Station Nathana, Bathinda, to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Bathinda.
