This is the second petition filed under Section 438 Cr.PC for grant of anticipatory bail to the petitioner in case FIR No.37 dated 27.01.2020 registered under Sections 363, 366-A IPC at Police Station Civil Lines, District Police Commissionerate Amritsar. Earlier petition for grant of anticipatory bail was dismissed as withdrawn by this Court vide order dated 11.02.2020. No circumstance much less any ground has been put-forth by the learned counsel for the petitioner, which would warrant entertaining the instant petition within three weeks from the passing of the previous order. Be that as it may, the allegations levelled against the petitioner in the FIR in question reveal that the prosecutrix, who was a minor was enticed away by the petitioner. Thereafter, the petitioner solemnized marriage with the minor daughter of the complainant. In fact, after the solemnization of marriage with the minor, the petitioner along with the minor daughter of the complainant had approached this Court for protection of their life and liberty. Vide order dated 27.01.2020, this Court had then directed the authorities to look into the threat perception, if any, against the petitioner and the minor girl. Admittedly, the whereabouts of the daughter of the complainant are still unknown. In these circumstances, the custodial interrogation of the petitioner, who as per his own admission, has solemnized marriage with the minor girl, becomes imperative. Keeping in view the facts and circumstances of the case, no ground is made out to grant the anticipatory bail to the petitioner. Accordingly, the instant petition stands dismissed. However, it is made clear that nothing observed hereinabove would be construed as an expression on the merits of the case.
