The instant petition has been filed so as to challenge order dated 19.1.2015 (Annexure P-2) passed by learned Judicial Magistrate 1st Class, Patiala vide which the petitioner was ordered to be summoned so as to face trial arising of complaint bearing No.COMA/38/2015 dated 3.1.2015 titled 'Tajinder Singh Vs. Jasmeet Singh'.

When the matter was taken up on 9.3.2022, none had put in appearance on behalf of the petitioner and consequently the matter was adjourned for 8.4.2022. Even on 8.4.2022, there was no representation on behalf of the petitioner and consequently the matter came to be adjourned for 30.5.2022. When the matter was taken up on 30.5.2022, the following order was passed: "Learned counsel representing the petitioner submitted that although he had sent registered letter to the petitioner but he PANKAJ KAKKAR 2022.07.20 17:31 I attest to the authenticity and integrity of this document
( 2 ) CRM-M-10996-2020 (O&M) has not received any instruction from him, so as to pursue the matter. He has, however, requested for one more adjournment so as to make another attempt to seek instructions. In view of the aforesaid request, the matter is adjourned to 20.7.2022."

Learned counsel representing the petitioner has submitted that he has not received any instructions from his client and he has been unable to contact him. It has been submitted that vide order dated 26.8.2019 (Annexure P-3) passed by learned Judicial Magistrate 1st Class, Patiala, the petitioner had been declared a proclaimed person.

In view of the aforestated position, wherein the petitioner has been declared a proclaimed person and has not even chosen to pursue the present petition or to give any instructions to his counsel, this Court is of the opinion that such like person does not deserve any relief from the Court. The petition, as such, is dismissed.
