(ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.121 dated 23.08.2018 registered under Sections 302, 307, 452, 324, 323, 148, 149 IPC, Sections 25 and 27 of the Arms Act at Police Station Kamboj, District Amritsar.
Learned counsel for the petitioner inter alia contends that petitioner was not named in the FIR. Complainant in his supplementary statement after three days of recording the aforesaid FIR named the petitioner, but did not attribute any injury to anyone with datar, which, according to the complainant, petitioner was holding at the time of occurrence. There is a cross-case against the complainant party. Conclusion of trial may take sufficient long time. No useful purpose would be served by detaining the petitioner in jail. Heard.
