Similar was the position on the previous occasions. 3.

Instant petition has been filed under Article 226 of the Constitution of India for directing the official respondents No.1 to 3 to initiate proceedings against police officials for assaulting and illegally detaining the petitioners, who have also sought a direction to the respondents to grant compensation to them.

Upon notice, respondents have filed separate responses. In the short reply dated 13.10.2023 filed on behalf of respondent No.6, it has been submitted as under:- "14.

That from the inquiry, it is found that a case FIR no.10 dated 10.02.2023 under section 420, 406 IPC, 7, 13 (2) 88 Prevention of Corruption Act has been registered at Police Station Sadar Moga against Hardeep Singh alias Happy now petitioner no.2 a boyfriend of Manupriya petitioner no.1 and KAMAL SHARMA 2025.08.02 13:42 I attest to the accuracy and authenticity of this order/judgment.

CWP-5385-2023 -2the present petition has been filed just to create a pressure upon the police department to hamper the investigation of the above said case. Apart from this, Manupriya petitioner no.1 sent her statement through email to the effect that she does not want any action on the present petition and the present petition may kindly be filed. Petitioner no.2 Hardeep Singh alleged in the present petition that he received injury at Moga on 24.01.2023 but on the other hand he has been medico legally examined from Dr. B.R. Ambedkar, State Institute of Medical Science, Sector56, SAS Nagar on 27.01.2023 and the said hospital is situated at a distance of about 165 Km from Moga. Thus petitioner no.2 failed to explain in the present petition that why he has not got her medico legal examination from Civil Hospital, Moga.

So, in view of the above said facts and circumstances, the entire allegations levelled by the petitioners through the present petition are found to be false and baseless, so no further action has been recommended to be taken by the Superintendent of Police (Investigation), Moga and recommendation was made to file the said application.

15. That a detailed inquiry report no.843/M/R-SP (Inv) dated 05.07.2023 was submitted by Superintendent of Police (Investigation), Moga and the said inquiry report has also been seen and approved by Senior Superintendent of Police, Moga on 06.07.2023."

It seems that in view of the above development, petitioners are not coming forward to pursue the petition.

Petition is dismissed.
