The petitioner is seeking regular bail in FIR No.456 dated 23.06.2015, registered under Sections 376, 420, 406, 506 IPC, Police Station City Thanesar, District Kurukshetra.

Counsel for the petitioner contends that the petitioner is in custody since 06.11.2015 and nine witnesses have been examined. The counsel urges that the petitioner was a tenant on a shop owned by the complainant and false allegations have been levelled. The counsel urges that there is a dispute regarding money transaction and the false allegations have been levelled to blackmail him and the petitioner is 34 years old whereas the complainant is 55 years old and the prosecutrix is not appearing in the witness box.

Crl. Misc. No.M- 19378 of 2016 (O&M) The State counsel states that the petitioner had vacated the shop and the prosecutrix has not been examined yet. The copy of the MLR placed on record shows that there were allegations of sexual assault between July, 2013 to August, 2014. The trial is going at a slow pace. The prosecutrix has not appeared for her statement in the Court. Considering the circumstances, the petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of trial Court/Duty Magistrate with a rider that the petitioner would not tamper with the evidence or contact the prosecutrix .
