The present petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to protect the life and liberty of petitioners at the hands of respondents No.4 & 5.

Learned counsel for the petitioners contends that petitioner No.1 was married to respondent No.4 in the year 2006 and out of said wedlock, a male child was born in the year 2015. They also adopted a female child in the year 2014. However, respondent No.4 being a habitual drunkard used to beat petitioner No.1. Due to ill-treatment of the in-laws towards petitioner No.1, she left her matrimonial home in August, 2023 and started living at the house of her sister i.e. petitioner No.2. It is further contended that private respondents No.4 and 5 are threatening petitioner No.2 to send petitioner No.1 back to her matrimonial home otherwise they would kill them. Apprehending danger to their life and liberty at the hands of respondents No.4 & 5, petitioners have submitted PANKAJ KUMAR 2024.03.07 16:48 I attest to the accuracy and authenticity of this document
CRWP No.2150 of 2024 a representation dated 04.03.2024 (Annexure P-1) to respondent No.2 but no action has been taken so far.

Mr. Subhash Godara, Addl. A.G., Punjab, who is present in Court, accepts notice for the official respondents. Counsel for the petitioners is directed to supply a copy of complete paper book to the counsel appearing for the State during the course of the day.

Without commenting on merits of the case, I dispose of this petition with direction to respondent No.2 to decide the representation of petitioners (Annexure P-1) within a period of one week from the date of receipt of a certified copy of this order and grant them protection, if there is any threat to their life and liberty. It is made clear that this order shall not be taken to protect the petitioners from legal action for violation of law, if any committed by them.
