JASWANT SINGH, J (Oral) Prayer is for grant of regular bail in case FIR No.90 dated 27.5.2014 under Sections 22/61/85 of NDPS Act, P.S Sultanpur, District Kapurthala.

As per allegations, the petitioner was found to be in conscious possession of 60 grams of intoxicating substance. Learned counsel for the petitioner contends that the quantity of the contraband recovered from the petitioner is marginally commercial in nature. It is further contended that no other case is pending against the petitioner. Learned State counsel, on instructions from HC Rajinder Kumar, states that the charges are yet to be framed. Without commenting upon merits of the case and keeping in view the fact that the recovery effected is marginally

CRM-M-1940 of 2016 #2# commercial and not of much value and that the trial is not going to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars any longer. Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kapurthala.
