The present petition has been filed by the petitioner raising the issue of public nuisance arising out of pollution caused by respondents No.7 & 8 due to commercial activities of milk diary in close vicinity to the residence of petitioner.

Learned counsel for the petitioner does not dispute that an order of interim nature was passed by the Court of Sub Divisional Magistrate, Dhuri under Section 133 of the Code of Criminal Procedure in his favour on 23.10.2023 which was confirmed vide order dated 27.08.2024 subject to certain terms and conditions and thereafter the same was challenged by the petitioner herein in a revision petition before the Court of Additional District Judge, Sangrur.

In this view of the matter, since the issue is sub-judice before the Revisional Court at Sangrur, this Court would not like to enter into the merits of the case and leave it for the Revisional Court, Sangrur to adjudicate upon the issue involved and pass appropriate orders as expeditiously as possible. 4.
