ARVIND SINGH SANGWAN , J. (ORAL ) Prayer in this petition is for transfer of the petition filed by the respondent-husband under Section 10 of the Hindu Marriage Act, titled as "Lovedeep Vs. Milan" HMA No.362 of 2020, pending in the Court of learned District Judge, Family Court, Pathankot, to the competent Court of jurisdiction at Dasuya, District Hoshiarpur. Counsel for the petitioner submits that the petitioner has already filed an application under Section 125 Cr.P.C. which is at Dasuya Courts, District Hoshiarpur and petitioner has also got registered FIR No.17 RAJ KUMAR ARORA 2022.07.12 17:18 I attest to the accuracy and integrity of this document

TA-380-2021 (O&M) dated 7.2.2021, at Police Station, Tanda under Sections 498-A and 406 IPC, which is also pending at Dasuya and because of this, it is difficult for the petitioner to attend the Court proceedings at Pathankot, which is at distance of 20 kilometers as she cannot go there without the help of a male member and has to incur financial expenses.

After hearing the learned counsel for the parties and considering the facts and circumstances of this case, the present petition is allowed. The petition filed by the respondent-husband under Section 10 of the Hindu Marriage Act, titled as "Lovedeep Vs. Milan" HMA No.362 of 2020, pending in the Court of learned District Judge, Family Court, Pathankot, will be transferred to the competent Court of jurisdiction at Dasuya, District Hoshiarpur.
