On the instructions of ASI Jagwinder Singh, it has been informed that the petitioner has joined the investigation but has not disclosed the source of contraband.

I have heard counsel for the parties and I am of the opinion that opium was actually recovered from the possession of Karam Singh and Vishnu on the basis of secret information but the name of the petitioner was disclosed by co-accused Karam Singh and Vishnu after their arrest. The petitioner having been involved in the case on the basis of statement of an accomplice, his culpability will certainly be a debatable issue.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
