ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.38 dated 06.02.2014 registered under Sections 395, 397, 342, 307, 412 of the Indian Penal Code (in short 'IPC') and 25 of the Arms Act, at Police Station City Narwana, District Jind. Counsel for the petitioner has submitted that the petitioner was granted regular bail and he was regularly attending the Court proceedings, however, he could not appear before the trial Court on 05.02.2019 as he had to attend the Court proceedings in some other Court and on that account, his bail/surety bonds were cancelled.
It is further submitted that the petitioner, thereafter, surrendered before the trial Court and later, moved an application for bail, however, the same was declined by the Court vide order dated 20.02.2019. Counsel for the State, on instructions from SI Suresh Kumar has not disputed the factual position but opposed the prayer for MOHD YAKUB 2019.03.

Without commenting anything on merits of the case, considering the fact that the petitioner was earlier on bail and he has jumped the jail and thereafter, he was sent in judicial custody on 20.02.2019, this petition is allowed and the petitioner is directed to be released on regular bail subject to his furnishing bail/surety bonds, to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate. However, it will be open for the prosecution or the complainant to apply for cancellation of bail of the petitioner, in case he is found involved misusing the concession of bail, in any manner.
