Mr. Gagneshwar Walia, Addl.A.G. Punjab AMAN CHAUDHARY, J.

1.

The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for setting aside order dated 26.02.2024 (Annexure P-3), qua the petitioner, passed by respondent No. 2 whereby petitioner was transferred from Panchayat Samiti, Patiala to Head Office (R.D.E-I Branch), Mohali.

2.

Learned counsel would submit that the petitioner is 90% disabled and her mother is also bed-ridden. On promotion, she was transferred from Barnala to Mohali and within 01 month and 03 days, she has now been transferred to Mohali again, which is against the policy dated 23.04.2018 (Annexure P-5), which provides that 03 options have to be taken from disabled employee before transferring them. 3.

Learned State counsel on instructions submits that the matter is under consideration for posting the petitioner to Patiala or another place closer thereto, which shall be decided within a period of four weeks.

CWP-5486-2024 2024:PHHC:033480 4.

This satisfies learned counsel for the petitioner, who however prays that the impugned order be stayed in the meantime. 5.

In view of the statement made by learned State counsel, the present petition stands disposed of. However, the impugned order dated 26.02.2024 (Annexure P-3) qua petitioner, shall be kept in abeyance, till a decision is taken in the matter.
