Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.32 dated 17.04.2015 under Sections 420, 465, 468, 471 and 120-B IPC, registered at Police Station Satnampura, District Phagwara.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the prosecution version, present petitioner is a distributor and he has sold the SIMs to retailers and retailers have sold the same to the customers without taking proper IDs from them. CRM No.M-18513 of 2015 -2The petitioner has joined the investigation. He is not required for any investigation or interrogation purposes. He is stated to be only distributor and sold the SIMs to retailers and not directly to the customers. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find merit in the present petition and the same is allowed. The order dated 29.05.2015 granting interim bail to the petitioner is made absolute.
