Notice of motion.
Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. The perusal of the record shows that petitioners were filing applications for exemption before the trial Court and then they absented from the proceedings on 25.01.2019 and non-bailable warrants were issued VINEET GULATI 2019.03.15 13:01 I attest to the accuracy and authenticity of this document Chandigarh against them.
CRM No.M-11231 of 2019 -2The trial of the case will take long time. No useful purpose will be served by sending the petitioners to custody. However, as the proceedings are delayed due to absence of petitioners, therefore, petitioners are directed to deposit `10,000/- as costs with the District Legal Services Authority, Bathinda.
Finding merit in the present petition, the same is allowed. The petitioners are directed to appear before the learned trial Court within ten days from today and on doing so, they shall be released on interim bail by the learned trial Court to its satisfaction. If the petitioners fail to surrender before the trial Court within the stipulated period, then this petition shall be treated as dismissed. Depositing of costs will be within the precedent.
