H. S. Madaan, J. (Oral) Petitioner Iqbal Singh @ Gabar, an accused in FIR No. 80 dated 21.4.2017, for an offence under Section 22 of the NDPS Act, 1085, registered at police Station Sultanpur Lodhi, District Kapurthala, was granted interim bail by the trial Court, since chemical report with regard to the contraband recovered was yet to be received. Subsequently, report was received in affirmative and contraband recovered from possession of the petitioner was found to be of commercial quantity.

The petitioner did not surrender in the Court after dismissal of bail application on 8.8.2017 as mentioned in para 10 of the petition and now he is asking for grant of pre-arrest bail. Pre-arrest bail cannot be granted to him under such circumstances Dismissed.
