The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 19.04.1999 (Annexure P-8) whereby he was terminated from service. 2.

The petitioner worked with respondents from 1989 to 1999. The respondent is a Child Welfare Council. Deputy Commissioner is its Ex-officio President. The petitioner was appointed as Supervisor of Bal Bhawan operated by respondent No. 2. On account of financial crisis, the respondent closed its Bal Bhawans. It was not possible for the respondent to maintain the staff, thus, services of the petitioner were terminated.

A period of 26 years from the date of passing of impugned order has passed away. It is further disputed whether writ is maintainable against the respondent because divergent opinions of Courts are available. 4.

Considering the aforesaid facts and judgment of Supreme Court in Central Council for Research in Ayurvedic Sciences and another v. Bikartan Das and others, 2023 SCC Online SC 996, this Court does not find it appropriate to adjudicate the matter on merit.
