Petitioner has filed this petition under Section 439(2) Cr.P.C. for cancellation of anticipatory bail granted to respondent No.2 in case FIR No.307 dated 05.11.2016 under Sections 420, 406, 467, 468, 471 and 120-B IPC, registered at Police Station City Khanna, District Ludhiana and had not brought on record the actual facts of the matter, otherwise this Court would have dismissed the bail of respondent No.2.
I have heard learned counsel for the petitioner and have gone through the record.
Nothing has been argued in the present case, whether respondent No.2 has misused the concession of anticipatory bail or tried to tamper with the evidence or gave any threat to any of the witness or the complainant. The only ground for cancellation of anticipatory bail given by Vineet Gulati 2017.05.24 16:38 I attest to the accuracy and authenticity of this document Chandigarh the petitioner is that respondent No.2 has not brought on record the actual
CRM No.M-18580 of 2017 -2facts of the case. I find that the accused is not supposed to bring all the facts of the case on record. The facts are to be to be brought by the learned State counsel or by the complainant.
From the record, I find that order granting bail to respondent No.2 has been passed by this Court after perusing the police record etc. No ground is made out for canceling the anticipatory bail granted to respondent No.2.
Therefore, finding no merit in the present petition, the same is dismissed.
