(Oral) The allegations in this anticipatory bail against petitioner Simranjit Kaur are that she along with co-accused non-applicants had entered into an agreement to sell dated 28.10.2013 with the complainant being fully aware that she did not have any right, title or interest over the property and thus duped the complainant of a sum of Rs 3 lacs. The contention of counsel for the petitioner is that as per settlement, the petitioner has already paid a sum of Rs 40,000/- and handed over today in the Court, bank draft for a sum of Rs 2,60,000/- drawn on State Bank of Patiala which has been received counsel for complainant Mr. Harsh Garg along with complainant and states that he has no objection if the bail is allowed though the learned State counsel on this ground has sought DALBIR SINGH TIWANA 2015.07.09 16:02 I attest to the accuracy and authenticity of this document High Court, Chandigarh

Criminal Misc. No. M-18530 of 2015 -2to oppose the grant of bail. However, having regard to the totality of the circumstances that the parties have entered into compromise and that earlier the petitioner was allowed interim relief by this Court and learned State counsel submits that the petitioner has since joined the investigation and is no longer required for further investigation and nothing is to be recovered from her and that he has no objection if the interim order is made absolute. In the light of the statement made by learned State counsel, the interim bail granted to the petitioner vide order dated 5.6.2015 is made absolute till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court.
