The prayer in the present writ petition under Articles 226/227 of the Constitution of India is for issuance of a writ in the nature of mandamus directing the respondents to consider the daily wage service of the petitioner from the year 1980 to 04.05.1993 towards the total length of service as qualifying service for the purposes of pension and pensionary/retiral benefits and further for re-fixation of the pensionary/retiral benefits of the petitioner. The learned counsel for the petitioner would contend that through the petitioner has retired on 31.07.2015 after attaining the age of superannuation, however, he could not approach the authorities as he was paralysed. The learned counsel would further contend that now the petitioner has approached the authorities and has sent a Legal Notice dated 12.01.

2021 (Annexure P-1) for considering the request of the petitioner, however, no decision has been taken on the same. The learned counsel further states that at this stage the petitioner would be satisfied if a direction is issued to PARKASH CHAND 2021.03.

CWP No.7173 of 2021 -2respondent No.3 to take a decision on the Legal Notice dated 12.01.2021 (Annexure P-1) in a time-bound manner.

On the asking of the Court, Mr. Rajesh Gaur, Addl. A.G., Haryana has joined the session through video conferencing and accepts notice on behalf of all the respondents.

In view of the limited prayer made by the learned counsel for the petitioner, the present petition is disposed off with a direction to respondent No.3 to take a decision on the Legal Notice dated 12.01.2021. (Annexure P-1), in accordance with law, expeditiously and in any case within a period of three months from the date of receipt of a certified copy of this order.
