Learned counsel for the petitioner submits that the petitioner being a commission agent had brokered a deal between respondent No.4 and M/s Shiv Ganga Store, Kolkata in the year 2017. However, M/s Shiv Ganga Store, Kolkata withheld some amount on the ground that the quality of grains was not upto the mark leading to filing of a complaint by respondent No.4. It has further been submitted that infact a complaint under Section 138 of Negotiable Instruments Act also came to be filed at the instance of respondent No.4. It has been submitted that although the dispute is primarily between respondent No.4 and M/s Shiv Ganga Store but the petitioner is being unnecessarily dragged into the matter and is being called to the police station time and again. It has further been submitted that pursuant to the PANKAJ KAKKAR 2021.03.26 19:07 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-14160-2021 (O&M) notices issued to him earlier, he had already appeared before the Economic Offences, Wing, wherein his statement was recorded on 18.8.2020 (Annexure P-4).

Having heard the learned counsel for the petitioner and while refraining from making any expression as regards merits of the case or as regards veracity of averments made in the petition, the petition is disposed off with a direction that the petitioner be not repeatedly called to the police station in respect of the matter in hand and if ever, in case, he is required to be associated with the investigation or any information is to be elicited from him, then a prior written notice be afforded to him.
