Shamsher Singh v. Union Of India And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH LPA-299-2020 (O&M) Date of decision : 28.03.2022 Shamsher Singh ....Appellant V/s Union of India and others ....Respondents CORAM: HON'BLE MR. JUSTICE G.S. SANDHAWALIA HON'BLE MR. JUSTICE VIKAS SURI
Present:
None for the appellant.
Mr. Sunil Kumar Sharma, Advocate for Mr. Sandeep Godara, Advocate for the respondent-UOI. G.S. SANDHAWALIA, J.
(ORAL) Present appeal arises out of the impugned order dated 02.03.2020 passed in CWP-27889-2017 of the learned Single Judge refusing to exercise the jurisdiction against the order of transfer dated 29.08.2017. A period of almost 41⁄2 years has expired since the order of transfer was passed. Apparently, the petition seems to have been rendered infructuous keeping in view the nature of controversy as such. Even from the order of dismissal of the writ petition, more than two years have passed and no application was filed for stay. Apparently, the currency of the litigation has run out of its tenure.
Even counsel for the appellant is not present today. Accordingly, the present petition is dismissed as having been rendered infructuous.
Liberty is, however, given to counsel for the appellant to move an application, if still any dispute is pending consideration. (G.S.
