Learned counsel for the petitioner submits that he has express instructions from his client not to press the present petition on its merits. He, however, prays that since his recovery suit was filed in the year 2014 and there was an ex-parte decree in the petitioner's favour dated 19.02.2016, a direction be issued to the Trial Court to dispose of the petitioner's suit expeditiously.

Early disposal of a matter on its merits does not prejudice any party and therefore, the present petition is disposed of with a direction to the Trial Court to dispose of the petitioner's suit, filed in the year 2014, within a period of ten months from the date of receipt of a certified copy of this order, of course, after giving reasonable opportunity to both the sides to lead their respective evidence.
