(ORAL) Through instant petition under Section 482 Cr.P.C. prayer has been made for quashing order dated 28.09.2016 (Annexure P-2) passed by learned Judicial Magistrate Ist Class, Pathankot, in complaint No.NIACT/1732/2014 dated 16.12.2014, whereby petitioner has been declared as proclaimed offender.

Heard.

Without commenting on the merits of the case, present petition is disposed of with direction to the petitioner to appear before the trial Court. In case, petitioner appears and files bail application, the same shall be decided by the trial Court within two days in accordance with law on merits after hearing contentions of the petitioner and dealing the same. In case, contention of the petitioner is found false, in that eventuality the trial Court may pass any appropriate order against the petitioner. Till decision of the bail application of the petitioner, he shall not be taken into custody.
