******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No. 204 dated 26.12.2014 registered for the offence punishable under Section 306 of Indian Penal Code at Police Station Division No. 3, Jalandhar.

Heard.

Learned counsel for the petitioners submits that petitioners have complied with the order dated 31.05.2017 which was modified vide order dated 12.07.2017. They have put in appearance before the trial Court and have been allowed interim bail.

CRM-M-18671-2017 -2submits that the charges have been framed against them by the trial Court. While filing the challan, in this case the police has found the petitioners as innocent but later they were summoned by the trial Court on the application moved by the prosecution under Section 319 Cr.P.C. as an additional accused.

Keeping in view the above fact and the fact that the custodial interrogation of petitioners is no more required for further investigation in this case,, this petition is allowed and the order dated 12.07.2017 is made absolute subject to the condition that petitioners shall appear before the trial Court on each and every date of hearing. In the event of their nonappearance on any date, the trial Court will be competent to cancel their bail and forfeit the bail bonds and surety bonds and the petitioners may be taken into custody.
