PANKAJ JAIN, J. (ORAL) By way of present writ petition filed under Article 226/227 of the Constitution of India, petitioners pray for writ in the nature of mandamus directing the respondents to grant petitioners one notional increment for pensionary benefits on completion of one year full service and to refix their salary and pay all the accrued arrears along with consequential benefits.

The issue involved in the present writ petition is that the petitioners completed one year service on the day last day of the month prior to their retirement and would be thus entitled for annual increment. Counsel for the petitioners submits that legal notice already stands served at the behest of the petitioners and the same has been placed on record as Annexure P-5.

CWP No.5004 of 2023 -2consideration and the same shall be decided expeditiously within a period of 8 weeks from the date of receipt of certified copy of this order. Finding it to be a fair request, the present writ petition is disposed off with a direction to the respondents to consider the claim of the petitioners and decide the legal notice dated 4th of January, 2023 (Annexure P-5) within the time period as stipulated hereinabove. In case the petitioners are found to be entitled necessary relief be released to them within eight weeks thereafter.

However, in case the respondents are of the opinion that the claim of the petitioners merits rejection the same be adjudicated by passing a speaking order after granting opportunity of personal hearing to the petitioners.
