This is a petition under section 482 Cr.P.C. seeking a direction that cross-version of the petitioners on the basis of MLR dated 01.04.2015 may be recorded by the investigating agency; further investigation may be handed-over to some independent agency.
Heard.
FIR was lodged by Multan Singh who stated that his daughter Jyoti Rani aged 19 years was a student of BA Ist year in Girls College of Bhuriwalian. On 01.04.2015, his daughter has gone to college on foot. On way back from college, two persons namely Sanjeev Kumar and Manoj Kumar (petitioners no. 2 & 3 herein) had intercepted her on their motorcycle, teased her and caught hold from her arms. This was usual feature but she did not disclose due to fear. Multan Singh thereafter discussed the issue with the Panchayat. As the matter was being heard by the Panchayat, mother of petitioners assaulted and caused injuries to the complainant. Resultantly, instant FIR was registered. In my considered view, allegations in the FIR are serious. Same was AJAY KUMAR 2015.05.29 17:00 I attest to the accuracy and authenticity of this document
CRM-M 18643 of 2015 registered only on 01.04.2015. There is nothing on record to show that investigation is not being conducted in a fair and proper manner. There is, thus no ground to entrust the investigation to an independent agency. As regards cross version of the petitioners, they are at liberty to seek their remedy as per law. There is no ground to issue a direction in inherent jurisdiction of this court. Dismissed.
