As common issues are involved in the captioned petitions, with the consent of both sides, the same are hereby disposed of by this common order.
CWP-5035-2023 and connected cases -22.
The dispute is confined to membership of Kashtriya Sabha, District Kurukshetra which is a registered society in terms of provision of Haryana Registration and Regulation of Societies Act, 2012 (for short '2012 Act'). There were 22 founder members of the society. In 2021, the governing body decided to induct more members, accordingly applications were invited from eligible ones. 1325 persons applied for the membership. The governing body found 106 applicants eligible and accordingly a resolution was passed. The said resolution was set aside by District Registrar. At one point of time, the District Registrar appointed SDM, Kurukshetra as Administrator of the society. The Administrator invited applications and declared total 848 persons as members of the society. He conducted elections on 09.04.2023.
The result could not be declared on account of interim orders passed by this Court. Multiple petitions filed by different persons claiming membership or challenging membership are pending before State Registrar. The present petitions also relate to membership. The petitioners are claiming that they were appointed or are eligible to be appointed as member of the society. 3.
Learned counsel for the parties submit that to resolve the matter qua membership, this Court may appoint an independent officer to look into claim of all the petitioners herein as well as appellants/aggrieved persons before State Registrar qua pending appeals. 4.
The matter is pending before this Court for couple of years. The elections have already been conducted, however, society is headless because of withholding of result. There is need of governing body which cannot come into force until and unless result of elections is declared.

To resolve the matter and in view of statement of the parties, this Court finds it appropriate to appoint Mr. Mahender Pal, IAS, Deputy Commissioner, Hisar, as an authority to consider claim of petitioners herein as well as parties before State Registrar and pass an appropriate order with respect to membership within six weeks from today. If any person over and above 848 members (who participated in election held on 09.04.2023) is found eligible to cast vote or any person who had participated in the elections is found ineligible, fresh elections would be conducted. In the absence of aforesaid situation, the result of elections held on 09.04.2023 would immediately be declared. The fresh elections, if required, would be conducted by Administrator within three weeks from the date of passing order by aforesaid authority. It is made clear that aforesaid authority would decide dispute in question on merit. 6.
The parties at the first instance shall appear before aforesaid authority in his office at 11:00 AM on 30.04.2026 and thereafter as fixed by said officer.
