(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 429 dated 29.07.2015, registered at Police Station Assandh, District Karnal, who has been booked for having committed the offence punishable under Sections 376/323/120-B IPC .

Learned State counsel on instructions submits that voice sample of the prosecutrix is to be taken on 23.08.2016 and the report will come on 01.09.2016. However, the statement of the prosecutrix has been recorded and out of 13 witnesses, 06 have been examined. As per deposition of doctor, there were not external mark of injury on the prosecutrix. No semen was found on the clothes of the prosecutrix and thus, it can be presumed that the prosecutrix was not sexually assaulted.

Crl. Misc. No. M-19633 of 2016 -2Petitioner is in custody since 30.07.2015.

Keeping in view the period of incarceration of the petitioner, this Court feels that there is no need to detain the petitioner any longer. Accordingly, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Karnal.
