(ORAL) Learned counsel for the State does not deny what is stated by the learned counsel for the petitioner, that 04 of the arrested co-accused of the petitioner have already been admitted to bail by this Court, vide orders passed in different petitions filed in respect of each such co-accused. Counsel for the petitioner specifically draws attention to the order of this Court in CRM-M-12964-2017, dated 01.05.2017, in respect of one Amritpal Singh.

A perusal of the said order shows that the petitioner in that case was not apprehended at the spot, nor was he specifically named in the FIR; and it was only subsequently that he was arraigned as an accused on the statement of one Varun, to the effect that he remembered that earlier in the day when he was getting the liquor 'in question' loaded in the vehicle, various persons were seen roaming around, who thereafter in connivance with the aforesaid Amritpal Singh and his co-accused had robbed the vehicle.

CRM-M No.18732 of 2017 -2that the role of the petitioner is no different. In view of the fact that a co-accused similarly placed, Amritpal Singh, has been admitted to bail in the aforesaid petition, the petition is allowed and the petitioner, Jagroop Singh @ Joopa, is ordered to be admitted to bail, upon his furnishing surety bonds/bail bonds to the satisfaction of the learned trial Court, during the pendency of the trial, subject further to whatever conditions are imposed by that Court.
