******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.350 dated 27.09.2014 registered for the offences punishable under Section 382 read with Section 34 of Indian Penal Code, at Police Station Civil Lines, District Amritsar.
Heard.
Learned counsel for the petitioner submits that he has instructions to state at bar that petitioner has surrendered before the trial Court and has been allowed interim bail under the order dated 24.05.2017. Petitioner was on regular bail in this case and his bail was cancelled due to his non-appearance on 29.11.2016. CRM-M-18739-2017 -2No.468 of 2014, as such, could not appear. He was also summoned by Court through production warrants.
In view of submission of learned counsel for the petitioner but without expressing any opinion on the merits of the case, this petition is allowed and the order dated 24.05.2017 is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing. In the event of his non-appearance on any date, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and that the petitioner may be taken into custody.
