The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.18, dated 25.01.2026, under Sections 340, 336(3), 318(4) BNS, registered at Police Station Munak, District Karnal.

On 23.02.2026, the Co-ordinate Bench had passed the following order:- "The petitioner has filed the instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.18 dated 25.01.2026 registered under Sections 340, 336(3) & 318(4) of Bharatiya Nyaya Sanhita, 2023 at Police Station Munak, District Karnal.

Learned Senior counsel for the petitioner, inter alia, submits that the petitioner is innocent and has been falsely implicated in the present case on the basis of disclosure statement of co-accused namely Arvind Kumar, who is the real beneficiary. He further submits that the petitioner, being immigration consultant, has received his fee of Rs.3,86,000/- and the remaining amount of about Rs.14,00,000/- has been paid to the University at U.K. through bank transfers which are not in dispute. The issuance of forged certificates of Bachelor of Arts by the University of Lingaya's Vidyapeeth, Faridabad, deemed to be University approved under Section 3 of University Grants Commission (UGC) Act, 1956, to the co-accused Arvind Kumar and the alleged involvement of the petitioner would be a matter of Trial. He further submits that the petitioner has clean antecedents and no recovery is to be effected from him. He further submits that the petitioner is ready to join the investigation.

Mr. Sahil Choudhary, Advocate has put in appearance on behalf of co-accused, namely Arvind Kumar, and filed his power of attorney in the Court which is taken on record. Adjourned to 23.04.2026.

In the meanwhile, arrest of the petitioner shall remain stayed. He shall join the investigation and co-operate with the investigating agency and shall not leave country without prior permission of this Court."

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from ASI Sandeep Singh affirms the factum of joining the investigation by the petitioner on 08.03.2026and cooperating with the investigating agency. He also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 23.02.2026 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
