Through this writ petition, filed under Article 226 of the Constitution of India, the petitioner, who claims to be hard of hearing, prays for issuance of a writ in the nature of mandamus directing the respondents to identify one post of Assistant Professor (College Cadre) in Home Science for such category of persons. The petitioner submits that she is highly qualified and has cleared the National Eligibility-cum-Entrance Test conducted by the University Grants Commission. The petitioner claims that under The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, the State is required to make reservation for the persons suffering from such disabilities. It is claimed that although such broader reservation has been made for deaf and dumb persons, but not for deaf and hard of hearing persons.
