(Oral) CRM-988-2020 This is an application under Section 482 Cr.P.C., seeking adding of offence punishable under Section 406 IPC in the instant petition i.e. CRM-M10894-2019. It has been averred that during the pendency of the instant petition on 27.05.2019, it was brought to the notice of this Court that Section 406 IPC had been subsequently added in the FIR. Counsel for the applicant-petitioner had thus, prayed for time to file the supplementary application. Accordingly, in compliance to order dated 27.05.2019, the applicant-petitioner has preferred the instant application for adding Section 406 IPC in the instant petition. In view of the averments made in the application, which is supported by an affidavit of learned counsel for the applicant-petitioner, the Crl. Misc. Application is allowed and Section 406 IPC is ordered to be added in the array of offences mentioned in the instant petition (CRM-M-10894-2019). CM stands disposed off accordingly.

CRM-988-2020 IN/AND CRM-M-10894-2019 - 2 - CRM-M-10894-2019 The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No. 164, dated 29.10.2017, under Sections 498-A, 323, 506, 149 IPC and Section 406 IPC (added later on), registered at Police Station Kulgarhi, District Ferozepur. Learned counsel for the petitioner states that pursuant to order dated 11th March, 2019, passed by this Court, the petitioner has joined the investigation. This fact is not disputed by the counsel for the State as well. Learned State counsel on instructions from ASI Butaa Singh, states that the petitioner is no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 11th March, 2019, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
