(Oral) Prayer in this petition is for grant of regular bail to the petitioner in FIR No.15 dated 18.01.2018, for offence punishable under Sections 323, 324, 148, 149 of the Indian Penal Code (in short 'IPC') (Section 326 IPC added later), registered at Police Station Payal, District Ludhiana.
Counsel for the petitioner has submitted that before addition of Section 326 IPC, the petitioner was granted regular bail and he was re-arrested only after 01 month when Section 326 IPC was added. It is further submitted that the petitioner is in judicial lock up since 08.03.2018, the challan has been presented and the petitioner is no more required for any further investigation. Counsel for the State has filed the Custody Certificate today in the Court and on instructions from HC Pargat Singh, has submitted that the petitioner is in judicial lock up for the last 02 months and 08 days and he is not involved in any other case. CRM-M No.19672 of 2018 Without commenting anything on merits of the case and considering the fact that the petitioner was granted bail at initial stage and was re-arrested after addition of Section 326 IPC; challan has been presented; the petitioner is not involved in any other case and conclusion of the trial is likely to take some time, this petition is allowed and the petitioner is ordered to be released on bail subject to furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate.
However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found misusing the concession of bail, in any manner.
