RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 of the Code of Criminal Procedure has been made for grant of regular bail to the petitioner, namely, Rajbala in case FIR No.306 dated 07.09.2016 under Sections 302/147/149/201 and 120-B of the Indian Penal Code registered at Police Station Sadar, Gohana, Tehsil and District Sonepat. The aforesaid FIR was lodged by Om Parkash, Ex-Sarpanch of village Bidhal, District Sonepat against the petitioner and her three sons, namely, Mukesh, Sandeep, Sonu sons of Ranbir and Krishan son of Karambir, in all five persons, on the allegations of committing murder of Preeti, daughter of the petitioner, on finding her in objectionable condition with one Ajay son of Badal.

Learned counsel for the petitioner contends that the petitioner was not named in the FIR; she is 70 years old and is in custody since 8.9.2016. Till date, three prosecution witnesses have been examined before the trial court and nothing incriminating has come on the record against the Virender Kumar 2017.07.26 12:23 I attest to the accuracy and integrity of this document

Learned counsel for the State has fairly conceded that as on today, nothing incriminating material has come on the record of the trial court against the petitioner.

In view of the over-all facts and circumstances of the case that the petitioner is an old lady, aged around 70 years, and that nothing incriminating has come on record against her at this stage, the application is allowed. The petitioner is admitted to regular bail subject to her furnishing bail bonds and surety bonds to the satisfaction of the trial court. 25.7.2017 ( RAMENDRA JAIN ) VK JUDGE 1.
