Learned counsel for the petitioner contends that respondent No.5 is involved in many criminal cases and a show cause notice was issued to her on 25.09.2018 by the office of District Elementary Education Officer, Panipat, but till date, no further action has been taken against her.

Learned State counsel on the basis of advance notice submits that in pursuance of show cause notice issued to respondent No.5, she has submitted her explanation to the competent authority i.e. District Elementary Education Officer. CWP No. 14947 of 2021 -2Thereafter, a Committee was constituted by the District Elementary Education Officer and on the basis of findings of enquiry report dated 06.02.2020, no action has been taken against respondent No.5.

Faced with the situation, learned counsel for the petitioner seeks to withdraw the present petition with liberty to take recourse of remedy available to the petitioner in accordance with law.
