NAMIT KUMAR J. (Oral) As per office report, notice issued to the petitioner has been received back with the report "not residing at the given address". The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing respondent No.3 to pay the salary to the petitioner for the period 01.09.1997 to till date as the petitioner has worked on the post of Assistant Professor of Agriculture Education in the pay scale of Rs.2200-4000/-. Further prayer has been made to direct the respondents to regularize the services of the petitioner as he has put more than 3 years of service to his credit continuously and the services of the petitioner shall not be terminated and no new appointment shall be made after terminating the services of the petitioner. CWP No.7780 of 1999 (O&M) In the written statement filed by respondents No.1 to 3, it has been stated as under:- "2. That the salary of the petitioner amounting to Rs.85,806/- fr the period 1.9.97 to the date of his relieving from the University service i.e. 22.6.98 has already been released vide cheque No.450579 dated 12.8.99 and the cheque has been deposited in the salary/saving account of the petitioner in the State Bank of India, Punjab Agricultural University, Ludhiana. The petitioner has also been informed in this regard vide Memo No.19875-76 dated 9.9.99 (copy attached as Annexure R-3). Therefore, the writ petition is liable to be dismissed on this score also."

Since the relief claimed in the present petition has already been granted to the petitioner, therefore, the instant petition has been rendered infructuous. Even otherwise, there is no representation on behalf of the petitioner.

Dismissed for non-prosecution.
