Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari quashing the order dated 18.01.2024, Annexure P-4, whereby petitioner's claim for grant of third ACP was rejected on the ground that he is not fit for promotion for want of Bachelor of Physical Education qualification.

Learned counsel for the petitioner contends that the claim has been wrongly rejected, since the petitioner has already been granted first and second ACP scales on the basis of qualification he possesses. Besides, similarly placed PTI teacher, Rajbir Singh, has also been extended the benefit, vide order dated 18.09.2021, Annexure P-3, though he possesses similar qualification as that of the petitioner. In these circumstances, learned State counsel contends that the impugned order dated 18.01.2024, will be reviewed, and the respondents will pass a fresh order in accordance with law, considering the submissions made by learned counsel for the petitioner.

In view of the statement made, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof. 5.
