Instant petition has been filed under Section 439 Cr.PC for grant of interim bail to the petitioner in case FIR No.62 dated 13.07.2020 for the offences under Sections 376 and 506 IPC (Sections 376-D and 120-B IPC added later on) at Police Station Women Police Station, Sonepat District Sonepat.

On the last date of hearing i.e. on 05th April, 2021, learned counsel for the petitioner had restricted his prayer to grant of bail to the petitioner in the aforesaid case on the ground of medical condition of the petitioner's son, who is stated to be suffering from ventricular septal defect. Accordingly, while issuing notice of motion, learned State counsel was directed to verify the authenticity of the submissions made by learned counsel for the petitioner and to file a report with respect to the medical condition of the petitioner's son.

In compliance of order dated 05.04.2021, learned State counsel has filed the status report with respect to the medical condition of the SONIA BURA 2021.04.19 16:38 I attest to the accuracy and integrity of this document chandigarh

As per the status report, the son of the petitioner is indeed suffering from ventricular septal defect and is undergoing treatment from the Pediatric Cardiology AIIMS, Delhi. It has also been stated in the report that the son of the petitioner has been advised VSD closure surgery and has been given an appointment for the same on 19.04.2021. In the facts and circumstances of the case and in view of the status report filed by the State, present petition is disposed of and the petitioner is directed to be released on interim bail for a period of six weeks i.e. from 20.04.2021 to 02.06.2021 subject to the satisfaction of the trial Court/Duty Magistrate concerned.
