1. The present petition has been filed for quashing the memo dated 01.07.2020 issued by respondent No.1, whereby experience of the post of Senior Assistant revenue side in the Department of Revenue, required for promotion to the post of Superintendent Grade-II has been defined as only while performing duties in certain branches.

Learned counsel submits that during pendency of the present petition, petitioner No.1, who was at seniority No.3, stands promoted vide order dated 29.11.2023, Annexure P-22, whereafter, even those junior to petitioner No.2, who are at seniority Nos.5 and 6 have also considered for promotion, while he being at Seniority No.4, was still left out of the zone of consideration despite the fact that he was eligible for it as certified by Sub-Divisional Magistrate vide certificate dated 20.11.2023, Annexure P-16. In this regard, a representation dated 29.11.2023, Annexure P-21, has been submitted by him, whereafter, an appeal was also preferred before respondent No.1, which have yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is MOHIT 2024.05.03 09:42 I attest to the accuracy and authenticity of this order/judgment

## sanguine of it being considered in a positive manner keeping in view the aforesaid submission in particular that junior persons to him have been promoted, in case, a direction is given to the respondents to decide the same in a time bound manner by granting him an opportunity of hearing.
3. Learned State counsel has no objection to the limited prayer made. 4. In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the representation dated 29.11.2023 as also the appeal, taking into account the pleas raised therein as also the aforesaid facts submitted, within a period of 3 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same shall contain reasons and the petitioners shall be free to seek legal redress thereupon
