This is a petition filed under section 439 Cr.P.C. with a prayer for release of the petitioner on bail in a case registered vide F.I.R. No.18 dated 17.2.2015 under Sections 324,323452,506,34 I.P.C. (Sections 325,326 I.P.C. added later on) at Police Station Sadar, Banga. Learned counsel for the petitioner contends that petitioner is in custody since 21.2.2015 and challan has already been submitted. Cr.M.No.M-18764 of 2015 -2fixed for recording of evidence. He further contends that Sections 325 and 326 I.P.C. have been added subsequently.

The aforesaid facts are not controverted by the learned counsel for the State who however, states that the petitioner is involved in a serious occurrence of violence where four fractures were noticed on the person of the injured. After hearing the learned counsel for the parties and noticing the fact that the petitioner is in custody since February, 2015 and no useful purpose will be served by keeping the petitioner in jail particularly when the trial is likely to take some time, I deem it appropriate to accept the instant petition and release the petitioner on bail to the satisfaction of the trial Court/Duty Magistrate. Nothing stated hereinabove shall be construed to be an expression of opinion on the merits of the case.
